BVRLA ignore their “mandatory” code of conduct.
The BVRLA is the “British Vehicle Rental and Leasing Association”.

Established in 1967, the BVRLA claims it is the trade body for companies engaged in the leasing and rental of cars and commercial vehicles.
I have a big problem with this BVRLA! They allow their leasing members to repeatedly and consistently breach their “mandatory” code of conduct and advertise illegally.
One of the BVRLA’s main claims is that: “The association regulates the industry through a regular series of quality assurance inspections and a mandatory code of conduct.”
The BVRLA says: “It is the code by which members conduct their business. It sets out the general principles by which BVRLA members should operate.”
Well, I have news for the BVRLA: THEIR “MANDATORY” CODE OF CONDUCT IS BROKEN BY AT LEAST 75% OF THEIR LEASING MEMBERS! – not only that, but I have repeatedly made their legal officer and Chief Exec aware of this, and still the BVRLA allows members continue to advertise criminally.
Adverts like the one below are totally illegal.

Most BVRLA member leasing websites advertise cars to consumers ex-VAT. This makes their prices appear 15% cheaper than mine. It is deliberate misrepresentation. In law, this is a criminal act. Yet, the BVRLA endorse these actions with their logo!
The BVRLA Code of Conduct says: “Advertising – Ensure that all advertising material and literature contains no misleading nor inaccurate statements…(and)… Members will also ensure that they adhere responsibly with all relevant legislative requirements.”
Yet the Consumer Protection from Unfair Trading Regulations 2008 says: “All price indications you give to consumers, by whatever means, should include VAT. This total price must be displayed prominently so that consumers can see it. Prices may ONLY be indicated exclusive of VAT at an outlet or through advertisements from which ALL of your business is with business customers.”
WHY DOES THIS MATTER?
What this means is that a car one of these companies advertises for £99 a month, will actually cost the consumer £114 a month. That is clear misrepresentation and is designed to mislead private buyers.
It matters because:
1) Illegal advertising is unfair.
2) Consumers are misled.
3) It is unfair competition on businesses acting lawfully.
4) A trade body like the BVRLA should act to stamp out this criminal advertising, not parade their logos next to it!
5) Like for like, this criminal advertising makes my prices look 15% (the VAT amount) more expensive.
A “misleading omission” on an invitation to purchase, is a criminal offence…
…so when you see adverts or websites or prices from other contract hire and leasing companies (some very “reputable”) which either ignore VAT, or say “+VAT”, and the prices are meant for consumers as well as business customers, you can ask yourself;
“WHY ARE THEY TRYING TO MISLEAD ME???”
I deplore the way the BVRLA gives its members credibility but turns a blind-eye to mass illegal advertising which misleads consumers!
I demand action from the BVRLA to clean up their act!
ALL car leasing websites should comply with UK law. The BVRLA needs to stop ignoring these mass breaches of it’s code of conduct and force member companies to clean up their acts! Due to this complete neglect for it’s duties, and lack of concern for consumers’ issues, I refuse LINGsCARS to join the BVRLA.
